Stabbing at Barbeque Leads to Conviction

Prosecutors in DA Charme Allen’s Major Crimes Unit obtained a conviction against a defendant who stabbed another man at a barbeque. Frank Deford Kincaid, 60, was convicted of Attempted Second Degree Murder. Judge Scott Green set the case for sentencing on November 18. In a two-day trial, Assistant District Attorneys Sean Roberts and Hector Sanchez explained to the jury that on October 11, 2019, Kincaid and the victim were attending a barbeque at Victor Ashe Park. The two began arguing about who would light the grill. Kincaid and the victim were arguing face-to-face when the victim pushed Kincaid and walked away. Kincaid then pulled a knife from his pocket and rushed the victim, stabbing him at least eleven times in the chest, stomach, arm, and back. One of the stab wounds damaged the victim’s heart causing cardiac arrest. Knoxville Police Department officers and EMS responded to the scene. The victim was resuscitated by paramedics on the way to UT Medical Center where he underwent emergency open heart surgery that saved his life. Under Tennessee law, Attempted Second Degree Murder is a Class B felony that carries a punishment between eight and twelve years. At sentencing, prosecutors will ask for the maximum sentence based upon the nature of the offense and the fact that Kincaid has a previous conviction for Domestic Assault where he repeatedly punched his girlfriend in the face.
