Fight with Officers Leads to Resisting Arrest and Assault Convictions

Prosecutors in District Attorney General Charme Allen’s office obtained convictions today against a man who fought with officers who were attempting to arrest him. Ernesto Delgadilo Rodriguez, 32, was convicted by a jury of Resisting Arrest and Assault. Judge Bob McGee set the case for sentencing on April 28.

In a two-day trial, Deputy District Attorney Kyle Hixson explained to the jury that on July 9, 2014, the Knoxville Police Department responded to a 911 call on Roaming Avenue. The 911 caller stated that Rodriguez had returned home at 4217 Roaming Avenue at around 5:00 A.M. When he returned home, the caller stated Rodriguez was high on cocaine and arguing with his girlfriend and other residents of the house. During the argument, Rodriguez grabbed a knife and continued threatening his girlfriend. At one point, Rodriguez locked several children out of the house. He eventually went outside and slashed the tires of his girlfriend’s minivan. With the information that Rodriguez was violent, armed, and high on cocaine, Ofc. Fred Kimber responded to the area and found Rodriguez walking down Roaming Avenue. When Ofc. Kimber started putting Rodriguez in handcuffs to investigate the domestic disturbance, Rodriguez became violent, attempting to elbow Kimber. Rodriguez continued to resist arrest until three officers were able to take him into custody.

“”This case highlights the dangers faced by law enforcement officers every day,”” said DA Charme Allen.””These brave men and women do not hesitate to charge headlong into what they know to be a dangerous situation in order to protect complete strangers in the community.””
