Defendant Convicted in Home Invasion Burglary

Prosecutors in DA Charme Allen’s Criminal Court Division obtained a conviction today following a home invasion burglary in Fountain City. After a two-day trial, Justin Patrick Kiser, 20, was convicted of Facilitation of Aggravated Burglary and Theft. Judge Steve Sword set the case for sentencing on August 11.

At trial, Assistant District Attorney Randall Kilby explained to the jury that on May 29, 2014, the victim returned to his home on Garden Drive in Fountain City and discovered that a kitchen window had been pried open. Once inside, the victim discovered that multiple firearms, jewelry, and electronics, including a Nook e-reader, had been stolen from his home. A day later, Kiser registered the stolen Nook e-reader online using his name and address. Knoxville Police Department Investigator David Ogle went to Kiser’s address and found him in possession of the Nook. Officers were also able to recover three palm prints from the point of entry of the victim’s house that were later identified as the prints of Justin Kiser.

Facilitation of Aggravated Burglary is a Class D felony that carries a punishment between two and four years.
